The Ptuj District Court (the Republic of Slovenia) awarded damages in the amount of EUR 17,000 for denied work permit to Mr. Aleksandar Todorovic, a person unlawfully erased from the Slovenia permanent resident registry in 1992.
After a long, hard battle, Mr. Todorovic regained his residence permit in 1996, but was granted foreigner’s permanent residency status and was deprived of the right to gain a work permit for the following 10 years from the moment his first residency.
Although Mr Todorovic had actually lived in Slovenia much earlier than 1996, Slovenia did not, however, recognize this legal break in residency, from 1992 (deleted from the registry) to 1996, as a consequence of unconstitutional erasure from permanent resident registry in 1992, but simply considered that he gained his permanent residency only in 1996, Mr Todorovic instituted legal proceedings against the Republic of Slovenia for being unlawfully deprived of the right to work. The decision of the Court is the first case of awarded damages to anyone of the erased, although the Court did not rule on the very act of erasure from the permanent resident registry, but on the consequences of that act.
