The Law on Asylum of the Republic of Serbia, adopted on December 12, 2007, became effective from April 1, 2008. According to the Law, the asylum procedure consists of two steps, in the first instance Asylum Office of the Ministry of Interior grants/denies asylum to the asylum seeker on his/her request, while in the second instance the decision is made by the Asylum Commission formed by the Serbian Government.
According to Article 67, par. 2 of the Asylum Law, the head of the Commissariat for Refugees is responsible for issuing regulations on internal organization and systematization of work positions in the Asylum Center, as well as regulations defining accommodation standards, house rules, basic living conditions, and registration of persons hosted by the Asylum Center. In accordance with the above, the Commissariat for Refugees prepared the following: Book of Regulations on Asylum Center House Rules (Official Gazette of RS, No. 31/2008), Book of Regulations on Asylum Center Accommodation Standards in providing basic living conditions, both according to the Article 21 of the Asylum Law, as well as Book of Regulations on Registration of Asylum Seekers, defining the way and content of data collected from the persons accommodated in the Asylum Center, according to the Article 64, par. 3 of the Asylum Law. All three Books of Regulations came into force on March 28, 2008, and became effective from April 2, 2008 as the new Asylum Law.
Very soon, other regulations concerning social welfare (to be provided to asylum seekers, i.e., asylum granted person) and medical examinations to be performed upon reception in the Asylum Center will be adopted. Also, regulations dealing with the form and content of the Asylum Application Form, certificate for persons who show intention of applying for asylum, ID card for persons applying for asylum, ID card for persons granted asylum, as well as the form and content of travel document for recognized refugees, will be adopted by the Minister of Interior. Also, the Ministry of Interior is responsible for issuing regulations on the manner of keeping records and carrying out registration procedure of asylum seekers, as well as regulations on the content of records according to Article 64 of the Asylum Law.
